With regard to conducting an investigation, it is the mutual objective to preserve to the maximum extent possible the confidentially of all information generated or received in the course of consultation and investigation to communicate, both oral and in writing to the client.  All activities in connection with an investigation being conducted in anticipation of litigation, including obtaining information from the client, its counsel, agent and any third parties, and the transmitting of information to the client and its counsel, agents and any third party shall be subject to attorney client privilege, Through Work Product, and all other legal protections that may apply.

Accordingly, all information and communications provided, including but not limited to, work papers, records, notes, and files, whether oral or written, will be maintained by Kalmbach & Associates Inc., as confidential and will not be disclosed to anyone other than the client, without the written approval of the client, except as may be otherwise required by law. Independent of reliance upon attorney work product privilege in preserving the confidentiality of information and communication, Kalmbach & Associates Inc. agrees that it is appropriate to also rely upon the work-product doctrine enunciated by the United States Supreme Court in Hickman v. Taylor, 329 U.S. 495 (1947).

Verbal and written updates of the results of an investigation will be provided as the investigation proceeds with a formal written report to follow upon the completion of the inquiry. An invoice containing an itemized accounting of services will be forwarded to on a weekly basis. Payment of an invoice is due upon receipt by The Client
